Terms of Service
These Terms of Service (the "Terms") set out the conditions for using the couple-portrait photography service (the "Service") provided by AILÉA (the "Studio"). Customers use the Service on the understanding that they agree to these Terms.
1. Application
These Terms apply to all dealings between the Studio and the customer concerning use of the Service. Any guidance or notes the Studio separately provides in relation to the Service form part of these Terms.
2. Reservations & Applications
- Reservations should be made using the Studio's designated form or another method specified by the Studio.
- A reservation is not confirmed at the time of application. It is established only when the Studio has checked availability and sent you a confirmation.
- Reservations are accepted for dates up to three months from the date of application.
- The Studio may decline an application if it contains false information or if the Studio otherwise considers it inappropriate.
3. Fees & Payment
The Service fee, option fees, and the methods and timing of payment are as stated on the Studio's plan page and in the Legal Notice (Specified Commercial Transactions Act). All displayed prices include tax. Shipping fees apply separately to physical items such as photo goods.
4. Cancellation & Rescheduling
Cancellations and date changes after a reservation has been established are subject to the Studio's cancellation policy. Whether a cancellation fee applies and its amount are as stated in the Legal Notice (Specified Commercial Transactions Act).
For cancellations or date changes made for reasons attributable to the customer, the cancellation fee is as follows: free of charge up to two days before the shoot date; 50% of the shoot fee on the day before the shoot date; and 100% of the shoot fee on the day of the shoot. Date changes are treated in the same way.
5. The Shoot
- The shoot proceeds according to the guidance of the Studio's staff.
- You may shoot in your own clothes or with costumes and props you bring; however, for safety, please do not bring dangerous items. The Studio cannot be held responsible for damage to or loss of items you bring.
- If the Studio's facilities, equipment, costumes, or similar are damaged, soiled, or lost through the customer's intent or negligence, you may be asked to compensate for the loss.
- If there is conduct that disturbs other customers or staff, or that is contrary to public order and morals, the Studio may stop the shoot. In such cases, fees are non-refundable.
6. Photo Data & Deliverables
- The Studio selects and retouches the photo data and delivers the number of images specified in each plan.
- Photo data is retained for three months from the shoot date. Please place any orders for photo items or requests for additional data promptly, within the retention period.
- Copyright in the delivered data belongs to the Studio. Customers may use the data within the scope of private use.
7. Use of Photographs & Likeness
Where the Studio wishes to publish photographs it has taken for purposes other than providing the Service — such as on its website, social media, advertising, or as portfolio examples — it will do so only with the customer's prior consent. Even after consent has been given, the Studio will act on a customer's request to stop such publication.
Photo data shot at the Studio and purchased by you may be used freely within the scope of personal, non-commercial use. If you wish to use it for commercial purposes — such as promotion, advertising, or monetization — please apply in advance.
* If unauthorized commercial use is identified, the Studio may take measures including additional billing, suspension of use, and, where necessary, legal action.
Personal information is handled as set out in the Privacy Policy.
8. Prohibited Acts
In using the Service, customers must not engage in the following:
- Acts that violate laws or public order and morals.
- Acts that infringe the rights or interests of the Studio, other customers, or third parties.
- Acts that harass the Studio's staff or obstruct its operations.
- Providing false information.
- Any other act the Studio deems inappropriate.
9. Disclaimer
- If the shoot becomes difficult to carry out due to natural disasters, equipment failure, or other unavoidable causes, the Studio will respond by rescheduling and is not liable for any resulting loss to the customer.
- Except in cases of the Studio's intent or gross negligence, the Studio is not liable for any loss incurred by the customer in connection with the provision of the Service.
- Even where the Studio bears liability for damages, the amount is limited to the fee the customer paid for the relevant Service.
10. Handling of Personal Information
The Studio handles personal information obtained in providing the Service appropriately, in accordance with its Privacy Policy.
11. Changes to These Terms
The Studio may change these Terms without prior notice to customers where it deems it necessary. The revised Terms take effect when posted on this page.
12. Governing Law & Jurisdiction
The interpretation and application of these Terms are governed by the laws of Japan. The Kyoto District Court shall be the court of exclusive agreed jurisdiction of the first instance for any dispute arising between the Studio and the customer in relation to the Service.
